Linkt - Terms of Service

1. Agreement to Terms

By downloading, installing, or using Linkt (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App. The App is developed and operated by Fog Hill LLC (“we,” “us,” “our”).

2. Description of Service

Linkt is a mobile application for building and maintaining daily habits through streak tracking, community accountability, challenges, and gamification. The App enables users to create habit streaks, track progress, earn badges and XP, participate in community challenges, and connect with friends.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

Account Creation

To access certain features of the App, you may create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Deletion

You may delete your account at any time through the App’s Settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

5. Subscriptions and Payments

Free Tier

The App offers free functionality including basic habit tracking (up to 5 streaks), limited streak freezes, and access to core community features.

Specific pricing is displayed within the App and may change from time to time.

Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions in your App Store account settings.

Free Trials

If a free trial is offered, it will be clearly indicated at the point of purchase. You will not be charged during the free trial period. If you do not cancel before the trial ends, the subscription will automatically convert to a paid subscription.

Refunds

Payments are processed through the Apple App Store. For refund requests, please contact Apple directly through the App Store. We do not issue refunds directly.

Restore Purchases

If you have previously purchased a subscription, you can restore it by tapping “Restore Purchases” in the App’s Settings or on the paywall screen.

6. User Content

Your Content

You retain ownership of any content you create and share within the App, including community posts, comments, and habit names. By sharing content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content within the App.

Prohibited Content

You agree not to post content that:

7. Intellectual Property

The App and its original content, features, and functionality are owned by Fog Hill LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The habit tracking and health information provided in the App is for informational purposes only and does not constitute medical advice. Consult a healthcare professional for medical guidance.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOG HILL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in New York, New York.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fog Hill LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, your violation of any rights of another party, or any content you create or share through the App.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York, New York.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms in the App and updating the “Last Updated” date. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
