SkinCycle - Terms of Service

1. Agreement to Terms

By downloading, installing, or using SkinCycle (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App. The App is developed and operated by Fog Hill LLC (“we,” “us,” “our”).

2. Description of Service

SkinCycle is a mobile application that helps users create and manage their skincare routines. The App enables users to build AM and PM skincare routines, log daily adherence, and track product usage over time. All data is stored locally on your device using Apple’s SwiftData framework. No data is uploaded to external servers.

3. Health and Skin Disclaimer

SkinCycle is NOT a medical device, medical app, or health care product. The App is intended for general wellness and personal tracking purposes only. It does not provide medical advice, dermatological diagnoses, or treatment recommendations.

• The App does not evaluate the safety, efficacy, or interactions of any skincare products you log.
• The App does not recommend, endorse, or suggest any skincare product, ingredient, or regimen.
• Information displayed in the App (such as routine tracking and usage stats) is for personal organizational use only and should not be interpreted as dermatological or medical guidance.
• Always consult a qualified healthcare professional or dermatologist before starting, stopping, or changing any skincare regimen, especially if you have a skin condition.
• If you experience any adverse skin reactions or health effects, discontinue use of the product and seek medical attention.

By using the App, you acknowledge and agree that Fog Hill LLC is not liable for any skin reactions, health outcomes, adverse effects, or consequences arising from your use of skincare products, regardless of whether such products were logged in the App.

4. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. User Accounts

SkinCycle does not require account creation to use core features. If you purchase a subscription, your purchase is associated with your Apple ID and managed through Apple’s App Store.

6. Subscriptions and Payments

Free Tier

The App offers free functionality including basic routine creation and tracking tools with usage limits.

Paid Subscriptions

• SkinCycle Pro Monthly: $2.99/month. Provides unlimited routine creation, full tracking and usage stats, and all premium tools.
• SkinCycle Pro Annual: $19.99/year. Same features as Pro Monthly at a discounted annual rate.

Billing and Renewal

Subscriptions are billed through your Apple ID account. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your Apple ID account settings at https://apps.apple.com/account/subscriptions.

Refunds

All purchases are final and non-refundable except as required by applicable law or Apple’s refund policies. To request a refund, contact Apple directly through the App Store.

Price Changes

We reserve the right to change subscription prices at any time. Price changes will take effect at the start of the next subscription period following notice to you.

7. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Attempt to reverse engineer, decompile, or disassemble any part of the App
• Use the App as a substitute for professional medical or dermatological advice, diagnosis, or treatment
• Engage in any activity that interferes with or disrupts the App or its associated services

8. Intellectual Property

Our Content

The App, including its design, features, functionality, and all content created by us, is owned by Fog Hill LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

Your Content

You retain all rights to the data you enter into the App. All routine and tracking data is stored locally on your device using SwiftData and we never access or store your data on our servers.

9. Privacy

Your use of the App is governed by our Privacy Policy, available at https://foggy-labs.github.io/privacy/skincycle/. By using the App, you agree to our collection and use of data as described in the Privacy Policy.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses or other harmful components
• Any results obtained from use of the App will be accurate or reliable
• The App is suitable for making health, medical, or dermatological decisions
• Routine tracking data or usage stats will be complete or error-free

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOG HILL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF HEALTH DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FOG HILL LLC SHALL NOT BE LIABLE FOR ANY SKIN REACTIONS, HEALTH OUTCOMES, ADVERSE EFFECTS, INJURIES, OR DAMAGES ARISING FROM YOUR USE OF SKINCARE PRODUCTS, WHETHER OR NOT SUCH PRODUCTS WERE TRACKED USING THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fog Hill LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in New York, New York.

15. Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York, New York.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the “Last Updated” date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
