1. Agreement to Terms

By downloading, installing, or using Aesthetics (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App. The App is developed and operated by Fog Hill LLC (“we,” “us,” “our”).

2. Description of Service

Aesthetics is a mobile application that provides AI-powered facial aesthetic analysis. The App analyzes a user-submitted photo to generate a report including an aesthetic score, facial structure analysis, style archetype identification, and a personalized optimization plan focused on grooming, styling, and presentation. All analysis reports are stored locally on your device.

3. Important Disclaimers

This is not a medical, psychiatric, or identity assessment. It will never recommend surgery, procedures, or weight changes.

Aesthetics is intended for personal grooming and style optimization purposes only. It is not a medical device, medical app, or health care product.

• The App provides one stylistic perspective for grooming and presentation. It is not a definitive or objective assessment of appearance.
• The App does not provide medical advice, diagnoses, or treatment recommendations.
• The App does not evaluate mental health, self-worth, or personal identity.
• Analysis results are generated by AI and may contain inaccuracies. Results should be interpreted as suggestions, not prescriptions.
• Individual results vary based on photo quality, lighting, angle, and other factors.

By using the App, you acknowledge and agree that Fog Hill LLC is not liable for any emotional, psychological, or physical outcomes arising from your use of the App or interpretation of analysis results.

4. Age Requirement

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age. We do not knowingly provide services to anyone under 18.

5. Acceptable Use

You agree not to:

• Use the App to analyze photos of anyone other than yourself without their explicit consent
• Upload photos of minors
• Use analysis results to harass, bully, or demean any person
• Attempt to reverse-engineer, decompile, or extract the analysis algorithms
• Use the App for any unlawful purpose
• Misrepresent analysis results as medical or professional assessments

6. Photo Usage and Privacy

• Photos you submit are sent to a third-party AI service for analysis and are immediately discarded after processing.
• We do not store, save, or retain your photos on any server.
• Photos saved as part of your on-device analysis history remain on your device only.

7. Subscriptions and Payments

Free Tier

The App allows you to submit a photo and view your overall aesthetic score for free.

Paid Subscriptions

Premium features — including the full analysis report, archetype identification, optimization plan, and on-device analysis history — require a paid subscription. Subscription options and pricing are displayed within the App and are subject to change.

Billing and Renewal

Subscriptions are billed through your Apple ID account. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your Apple ID account settings at https://apps.apple.com/account/subscriptions.

Refunds

All purchases are final and non-refundable except as required by applicable law or Apple’s refund policies. To request a refund, contact Apple directly through the App Store.

Price Changes

We reserve the right to change subscription prices at any time. Price changes will take effect at the start of the next subscription period following notice to you.

8. Intellectual Property

The App, including its design, code, analysis algorithms, content, and branding, is owned by Fog Hill LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

Analysis reports generated for you are yours to use personally. You may share your own reports. You may not sell, redistribute, or commercially exploit analysis reports.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOG HILL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OF OR INABILITY TO USE THE APP
• ANY ANALYSIS RESULTS OR RECOMMENDATIONS PROVIDED BY THE APP
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• ANY THIRD-PARTY CONDUCT RELATED TO THE APP

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fog Hill LLC from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the “Last Updated” date. Continued use of the App after changes constitutes acceptance of the revised Terms.
